Making the decision to file for bankruptcy should be your last resort, but sometimes it is your only option. Understanding what it entails and how it will affect your financial future is critical. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 mandates that individuals must have pre-filing bankruptcy counseling and obtain a certificate of completion from an approved credit counselor in the District you will be filing bankruptcy in before proceeding with filing for bankruptcy.

Bankruptcy pre-filing counseling generally consists of a 60 to 90 minute meeting. Once you have completed the counseling you will get the mandatory certificate as proof that you have completed the pre-filing bankruptcy counseling.

Consumer Debt Counselors has been approved by the Executive Office for U.S. Trustees (click here to view disclosure statement) to issue bankruptcy counseling pre-filing certificates in compliance with the requirements of The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 for the following Judicial Districts: Approved to issue certificates in compliance with the Bankruptcy Code. Approval does not endorse or assure the quality of the Agency's services.

Post-Filing Bankruptcy Counseling
Once your bankruptcy has gone through you are then required to complete post-filing bankruptcy counseling. This course will include information on:

  • Developing a Budget
  • Managing Money
  • Using Credit Wisely

This meeting will last approximately 2 hours and like pre-filing bankruptcy counseling, once you have completed the course, you will receive a certificate stating you have met the mandatory requirement.

Bankruptcy Education Course 1 - Pre-Filing Counseling
The pre-filing counseling session will enable you to fully understand the potential advantages, disadvantages of, and alternatives to, declaring bankruptcy before taking action. You must complete and pass Course 1 before you can file for bankruptcy.

Bankruptcy Education Course 2 - Pre-Discharge Financial Management
The pre-discharge financial management educational course will provide you with the financial know-how you will need to manage your money, keep your personal finances in order and reduce the chance of future financial problems. You must complete and pass Course 2 before your bankruptcy can be discharged.
